Terms of Service
These terms describe a subscription service for businesses. You can collect through the Power Scraping Collector extension in your browser or through our hosted automatic browser using a reusable Instagram session you connect. Declared public profiles and explicitly authorized targets are supported; complete-history collection requires ownership, a creator contract or a client mandate with an auditable reference. We enrich, meter, store, archive and export collected material within your plan and instructions. Scheduled jobs can run unattended while access and authorization remain valid. The acceptable-use terms and data processing addendum apply; the controls reduce legal exposure without removing it. No VAT is charged: SVG ASSOCIATES LTD is not registered for VAT.
1. Who these terms are between
These terms are between you - the organisation named on the account, acting through every user on its seats - and SVG ASSOCIATES LTD, trading as Power Scraping, a company registered in England and Wales with company number 17391911, whose registered office is 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ ("we", "us"). Send notices to us at stefano@svgassociates.co.uk; we send notices to the email address of the account's owner. An account is created by the person who signs up; that person holds the owner role, confirms they have authority to bind the organisation to these terms, and only an owner may start or change a subscription.
2. Business customers only
The service is sold only to businesses. An account cannot be created without confirming it: when you sign up you confirm "I am using Power Scraping for my trade, business or profession" - by ticking that box on the dashboard's sign-up form or on the sign-in page a chat assistant opens, or by sending business_use: true to the sign-up API - together with your acceptance of these terms. That confirmation means you are acting for the purposes of your trade, business, craft or profession and not as a consumer, and we record it, with the time and the user who gave it, as the account's business-customer declaration. When an owner starts a subscription, checkout relies on that declaration, or takes it then if the account has none. We do not accept consumers as customers, so the rights that the law gives consumers who contract at a distance - including the 14-day right to cancel - are not offered. If you are a consumer, do not use the service. If we learn that an account is held by a consumer, we may close it and refund any fee paid for the part of the period not yet used, as the refunds clause says. Nothing in these terms takes away a right that the law gives you and does not allow a contract to exclude.
3. What the service is, and where collection happens
Power Scraping turns Instagram material into evidence-grounded venue and food intelligence. There are two collection modes. Extension mode uses the Power Scraping Collector in desktop Chrome, Edge or Brave, paired by a single-use code. Manual Send this post and opt-in automatic collection use your visible signed-in browser; the extension retains its own-account viewer guard, slow pace and daily caps, and its Instagram permission is removed when automatic mode is off. Hosted mode runs an automatic browser on the operator-configured server using your connected reusable Instagram session. Choose Connect Instagram in the dashboard to open an isolated browser running on our server. You interact with the real Instagram login page through a secure viewer and personally complete login and any two-factor verification. Your device encrypts clicks, keystrokes and typed text, including a password or verification code, to a temporary key held only by that browser runtime. Our HTTPS API and database relay encrypted input without being able to decrypt its contents. The runtime transiently decrypts input in memory and delivers it to Instagram; our service therefore processes your login input. The private input key is discarded when the browser closes and is not saved. Live page images return through a separately encrypted relay; password and form-input fields are masked, but other page content can be visible. We do not retain your Instagram password or verification code as reusable account credentials, and do not log input contents. The login expires after ten minutes; completion, cancellation, failure or expiry clears its active relay state and closes the browser. Historical encrypted screen images may remain in hosting backups until their normal expiry, as the privacy notice explains. Only your authenticated login interaction is used to establish a verified Instagram session, sealed with a tenant-specific encryption key in the database. The optional local helper instead establishes a session in your own browser and uploads only its encrypted bundle and key. The worker temporarily decrypts the session for your jobs, saves refreshed session material encrypted, and can run jobs and schedules unattended without a click for each run. You may disconnect that session and stop future use. Jobs are target-scoped: public-profile collection and explicit authorization bases are supported; complete_history requires own_account, creator_contract or client_mandate and a reference. Complete history is resumable across quota-bounded segments and may remain partial; a checkpoint or successful segment is not proof that every historical post was accessible. Hosted collection can include captions, comments and replies, carousels, images and video. Durable original-media archives apply to explicitly authorized recent collection and complete history. Public/research recent discovery keeps media links and local analysis without a durable binary archive. Local rules, OCR and video-frame analysis enrich that evidence; a configured remote AI endpoint and Google Places are optional, and disabled integrations are not promised as active. Results include citations, CSV and JSONL, review HTML and durable archives when generated. We do not use a third-party acquisition provider to collect for you. Both modes fail closed on warnings, challenges, blocks, rate limits and expired login: jobs stop or require reauthentication, and no challenge is bypassed. Extension challenges pause automatic mode for 24 hours. We will not evade controls, spoof fingerprints, solve CAPTCHAs or rotate proxies. We cannot promise access to a profile, an uninterrupted session or any particular number of posts.
4. Your Instagram account: your login, your risk, Instagram's terms
Collection uses an Instagram account you are authorised to use, either in your own browser or as a reusable session connected to the hosted worker. The risk to that account is yours: Instagram may issue warnings, challenges, temporary action blocks, restrictions or disable the account. Pace limits and fail-closed stops reduce that risk without removing it. Instagram's own terms govern your use and restrict automated collection without permission; you must comply with them. A profile being public is not a grant of Instagram permission or a lawful basis for every use of personal data. Do not connect another person's login without authority, or use an account you cannot afford to have restricted. In the hosted connection viewer you type into the actual Instagram page running on our server; this is not Meta OAuth or an official Instagram authorization integration. Your device encrypts password and two-factor input for that isolated browser runtime; our HTTPS API and database relay ciphertext, while the runtime transiently decrypts and delivers input to Instagram. We do not retain typed login input as account credentials or provide it to an AI assistant. After successful login, the validated reusable session is retained separately in tenant-encrypted form for hosted workers. Connection metadata and encrypted screen-image backup remnants follow the privacy notice. You may cancel connection or disconnect the saved session at any time. Challenges and expired sessions require you to reauthenticate; the service does not bypass them.
5. Plans, limits and the billing period
Every limit is declared in one place in the code and published at https://api.powerscraping.app/v1/plans. Free: no charge, 50 posts per period, 1 authorized target, 1 job queued at once, 1 seat, 7-day retention. Pro: GBP 20.00 per month, 2,000 posts per period, 10 targets, 2 jobs queued at once, 1 seat, 90-day retention. Agency: GBP 800.00 per month, 25,000 posts per period, 200 targets, 8 jobs queued at once, 10 seats, 365-day retention and priority support. No VAT is charged: SVG ASSOCIATES LTD is not registered for VAT. The metered unit is a post actually processed into completed useful output, not a promise of completeness or a charge for every image, comment or reply separately. Failed jobs, reauthentication stops and incomplete history capture segments are not metered, even when checkpoints are retained. Complete history reserves allowance for its final output, captures in bounded segments and meters the final enriched, durably archived campaign output once. That final output must fit its reserved period allowance; partial progress is not proof of completion. A job limit counts submitted unfinished jobs, not guaranteed parallel execution. Archive byte/file capacity is finite; large full histories require appropriate configured and verified durable storage. Media archives and reports follow the retention policy. A subscribed period is exactly the period Stripe reports; Free uses a rolling 30-day window anchored on signup, so subscribing and cancelling cannot reset its allowance. Extension automatic mode retains its separate small daily caps counted per Instagram account across every browser and organisation. Hosted work respects its configured pacing, access and plan limits. Exceeding a target, seat or concurrency limit means the next request is refused, not billed. Where the published plan list says "per month", it means per period as defined here. An extension post sent in the previous 24 hours is a duplicate and is not metered again.
6. Jobs stop at your allowance - there is no overage
Posts beyond your plan's included allowance are never charged, because there is no overage. Your subscription price is the most you are charged for a period, except that moving up to a higher plan part-way through a period adds the prorated difference described under billing. Every job holds its posts against the allowance when it is submitted, and a job that would take the period past the allowance is refused rather than run: jobs stop at the allowance. When the period's allowance is used up, new jobs are refused until the next period starts or an owner upgrades the plan.
7. Billing, renewal and cancellation
Paid plans are bought and managed through our payment provider, Stripe. An owner starts a subscription through a hosted checkout - relying on the declaration made at sign-up that the account is a business customer, or making it there if the account has none, and giving a billing address - and manages it (payment method, invoices, plan changes, cancellation) through the provider's billing portal, which we open for you. No VAT is charged: SVG ASSOCIATES LTD is not registered for VAT. Moving between Pro and Agency in the portal takes effect at once and is prorated by the payment provider: moving up adds a charge for the rest of the current period at the difference between the two prices, which appears on your next invoice; moving down gives a credit for the unused part of the higher price, which is set against your next invoices rather than paid back to your card. A subscription renews automatically each month at the then-published price until it is cancelled, and we will tell you by email at least 30 days before a price increase applies to you. Cancelling in the portal cancels at the end of the period you have already paid for: your plan and its limits continue until that date, and we do not bill you again. When the subscription ends, the account reverts to Free and the Free limits apply from that moment - including the 7-day retention window, which deletes collected records older than that. Download anything you need before you cancel: each job's records are available from the dashboard, and from GET https://api.powerscraping.app/v1/jobs/{job_id}/export with format=csv or format=jsonl. If a payment fails, the provider retries; while it is retrying you keep your plan and only the account's billing status changes. If those retries are exhausted or collection is paused, the paid entitlement stops and the account is served as Free until a payment succeeds or the subscription resumes. Your entitlement is only ever changed by an event the payment provider has signed: what you are charged for and what the service grants you are resolved from the same price identifier, so neither we nor you can assert a plan the subscription does not pay for.
8. Refunds: only in the three cases named here
Cancellation stops the next renewal; it does not refund the period already running, because the service stays available to you throughout that period. We refund in exactly three cases, and every other clause that mentions a refund refers to one of them. First, anything we billed in error - a duplicated charge, a charge for a plan you did not subscribe to, a charge after your cancellation took effect, or a charge above the published price or the prorated amount described under billing: tell us at stefano@svgassociates.co.uk and we will correct it and refund the difference to the original payment method. Second, if we close an account because it is held by a consumer (see "Business customers only"), we refund the fee paid for the part of the period not yet used. Third, if you end your subscription because we cannot reasonably meet your objection to a new sub-processor (see the data processing addendum), we refund the fees you prepaid for the period after it ends. Apart from these we do not give refunds: not for a part-used period, unused allowance, or a move to a lower plan - a move down earns the prorated credit described under billing, which is set against your next invoices and is not a refund. A job that fails - including one Instagram blocked or challenged - is not metered at all: a failed job counts nothing against your allowance. Because we sell only to businesses, the statutory cancellation rights of consumers do not apply.
9. Suspension and refusal
We may refuse a job, revoke a target, unpair a browser, or suspend an account. The grounds are the acceptable-use terms you accepted, and nothing wider: asking us, or modifying or scripting the extension, to evade a technical or contractual control - spoofing a device fingerprint, solving a CAPTCHA or other challenge, rotating proxies, sharing or reselling session credentials, spreading one target's collection across several browsers or Instagram accounts to get around a limit, or otherwise working around an access control - which is grounds for immediate suspension; connecting a hosted session or pairing a browser signed in to an Instagram account you are not authorised to use; collecting against a target whose declared authorisation basis is untrue, has lapsed, or cannot be evidenced; using the service or its output for special-category profiling, surveillance of private individuals, or any decision about a person that produces a legal or similarly significant effect; using the output to build an evasion capability; and attempting to reach another tenant's data. Suspension is an operator action recorded with its reason and its time; while an account is suspended every authenticated request is refused and no job can start. Non-payment is handled as described under billing - the entitlement drops to Free rather than the account being suspended. We will tell you the ground we relied on. Suspension does not end our retention and deletion obligations, or yours to any data subject.
10. What you warrant about your targets and your accounts
For every authorized target you warrant that its declared basis is true and current, your reference is genuine and auditable, and you have a lawful basis for processing the personal data. Supported declarations are your own Instagram account (own_account), creator contract (creator_contract), client mandate (client_mandate), public interest research (public_interest_research), and a public profile (public_profile). Public-interest and public-profile declarations do not establish Instagram permission or a lawful basis by themselves. Complete-history collection is restricted to your own account, creator contract or client mandate with a reference; the broader public bases are not sufficient for complete history. Revoke a target when its basis lapses. Every browser you pair and every session you connect must belong to an Instagram account you are authorised to use for this purpose. You are responsible as controller for the personal data, required notice and access, correction, objection and erasure requests. Declarations are attributed, timestamped and preserved after revocation. We do not verify account ownership or every contract independently; false declarations materially breach these terms. You indemnify us against third-party claims arising from a false declaration or breach of acceptable use.
11. The data processing addendum forms part of these terms
The Data Processing Addendum, version 2026-10-29, published at https://api.powerscraping.app/legal/data-processing (and as JSON at https://api.powerscraping.app/v1/legal/data-processing), forms part of these terms. It governs how we process the personal data in collected material on your behalf. By accepting these terms you accept it; it has no separate acceptance. If it conflicts with these terms on a data protection matter, the addendum prevails. Ordinary audit events are kept for 24 months and then deleted automatically. Unresolved account or membership deletion requests remain recorded for operator processing until completion is recorded for the exact request in the same account, even beyond 24 months. Completion proof is retained beyond 24 months only while its matching request is still within the ordinary audit retention window, so completed work does not reappear as pending. Once a completed request is outside that window, it and any expired completion proof are deleted by the purge. Recording a request does not delete the account or its data; erasure remains operator-assisted.
12. Limitation of liability
Two honest statements come before the cap. First: the controls this service enforces - declared targets, recorded authorisation bases, an audit trail, version-pinned terms, a collector that fails closed - make your conduct and ours more defensible. They do not make collection lawful in a jurisdiction where it is not, and nothing we publish is legal advice or a substitute for your own. Second: Instagram controls access to its service and to your account, and we refuse to evade it. So we are not liable for Instagram warning, challenging, restricting, blocking or disabling your account or your collection, for a profile becoming private or unavailable, for the accuracy of what a third party published, or for your own legal position towards the people whose data you collect. Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be limited or excluded. Subject to that, and except for your indemnity in the warranties clause: neither of us is liable to the other for loss of profits, revenue, business, goodwill or anticipated savings, or for any indirect or consequential loss; and our total liability to you arising out of or in connection with these terms, whether in contract, tort (including negligence) or otherwise, is limited in each period of 12 months to the greater of the fees you paid us in the 12 months before the event giving rise to the claim and GBP 100.
13. Versions, acceptance and change
These terms are versioned. Your acceptance is recorded against the exact version string you accepted, together with the time, the user who accepted, and a truncated form of the network the acceptance came from - never a full address. That record is immutable and is retained. Accepting terms requires a signed-in person: an API key or an unattended agent credential cannot agree to them on your account's behalf. Changing this text means issuing a new version, which you will be asked to accept; a checkout is refused until the current version is accepted. Acceptance of the current acceptable-use version is separately a precondition for collection: while it is outstanding, jobs are refused.
14. Governing law and disputes
These terms, and any dispute or claim (including a non-contractual one) arising out of or in connection with them or their subject matter, are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction to settle it. Before going to court, each of us will first try in good faith to settle a dispute by email within 30 days. We do not contract with consumers. If a court nevertheless treats you as a consumer, this clause does not deprive you of the protection of the mandatory rules of the law of the country where you live, and if you live in Scotland or Northern Ireland you may also bring proceedings in your local courts.
